Exclusion of liability

1. Content of on-line offer to sell
The Author assumes no liability for the up-to-date status, correctness, completeness or quality of the information provided. The Author assumes no liability for damages of a material or intellectual nature arising through the use, or non-use, of the information provided, and/or caused by the use of erroneous and/or incomplete information, in the absence of proven, deliberate culpability or gross negligence on the part of the Author.

All offers for sale are non-binding and without engagement. The Author reserves the right to amend, supplement or erase parts of pages, the entire offer for sale, or to cease publication, in whole or in part, temporarily or definitively, without separate notice.

2. References and links

Where direct or indirect reference (“links”) is made to other Internet sites outside the Author’s area of responsibility, liability shall be deemed to have been assumed exclusively in the event that the Author shall be proved to have possessed knowledge of the content thereof, and it may be assumed to have been technically possible and reasonable for the Author to prevent use thereof in the event of illegal content. The Author hereby expressly states that, at the time of establishment of the link, the linked pages contained no recognisably illegal content. The Author has no influence over the present or future wording, content or intellectual property rights of the linked/associated pages. He therefore expressly disassociates himself from the content of any and all linked/associated pages modified after establishment of the link. The present statement applies to all links and references established within the Author’s own offers of sale via the Internet, as well as to all entries by third parties in the Author’s guest books, discussion groups and mailing lists. The seller on the Internet site to which reference is made -- and not the person merely referring to that particular publication by means of Internet link -- shall be deemed to bear exclusive liability for any illegal, erroneous or incomplete content and, in particular, for any prejudice arising from the use, or non-use, of any such information provided.

3. Copyright and trademark law

The Author has made every effort, in all publications, to respect the copyright of all graphics, audio files, video sequences and texts, through the use of graphics, audio documents, video files and texts created by the Author personally, or through the use of license-free graphics, audio files, video sequences and texts.

All trademarks and commercial emblems displayed in the Internet offer of sale, and, if applicable, protected by third parties, are subject to unrestricted application of the provisions of Trademark Law applicable to that particular case, as well as to the property rights of that particular registered owner. The mere display of a trademark without further legal notice shall not be deemed to imply that the said trademark does not enjoy protection under third party copyright.

The Author of the page is the exclusive holder of the copyright to all objects created and published by the Author personally. Reproduction or use of any such graphics, audio documents, video files and texts in other electronic or printed publications without the express approval of the Author is prohibited.

4. Data protection

To the extent that the framework of the offer of sale involves the possibility of entering personal or commercial data (e-mail addresses, names, addresses), all such data will be deemed to have been supplied by the user on an expressly voluntary basis.

Your personal data will, therefore, be stored and processed according to the provisions of the German Data Protection Law. The processing and utilisation of your data for advisory purposes, advertising and market research will occur with your express consent only.

Insofar as technically possible and reasonable to do so, the services offered may also be utilised and paid for without entering any such personal or commercial data, through the entry of anonymous data or pseudonyms.

5. Legal effectiveness of the present exclusion of liability

The present exclusion of liability forms an integral part of the Internet offer of sale linked to this page. If any part of the present text, or the wording thereof, should fail to correspond, no longer correspond, or fail fully to correspond with the legal situation, the said circumstance shall be without prejudice to the contents and validity of the remaining parts of the document.
